CHAPTER 719: TELECOMMUNICATIONS COMMISSION

719.01 BRECKSVILLE TELECOMMUNICATIONS COMMISSION (BTC); ESTABLISHMENT AND MEMBERS; TERMS.

(a) There shall be established a citizens' advisory commission entitled the Brecksville Telecommunications Commission (BTC). The membership of this commission shall consist of one member of Council to be appointed by Council for a term of two years, and in addition six qualified electors of the municipality not holding other municipal office or appointment who shall be appointed by Council. The members of the Commission shall receive no compensation. Those individuals currently holding appointment for any position of the Brecksville Cable Television Service Advisory Commission shall, upon the elimination of such Commission, immediately become members of the BTC in the same positions and for the duration of the same terms as previously held for the Brecksville Cable Television Service Advisory Commission.

(b) Those persons other than the Councilman appointed to the Commission shall be appointed for a term of three years. Unexpired terms shall be filled in the same manner as original appointments.

719.02 DUTIES AND POWERS OF COMMISSION.

(a)The Commission shall have the following duties and responsibilities:

  1. Advising Council regarding general policy relating to the operation and uses of all aspects of telecommunications within the city with a view toward maximizing the diversity of programs and services to subscribers and users;
  2. Recommending to Council any potential changes or regulations governing any aspect of telecommunication within the city.
  3. Encouraging the use of available telecommunication services among the widest range of institutions, groups and individuals within the city;
  4. Encouraging cooperation with the local schools, library and other institutions located in the city or in neighboring communities with a view toward utilizing the facilities located therein to enrich the quality and diversity of telecommunication goods and services;
  5. Advising Council of changes in the state-of-the-art of telecommunications technology and the applicability of same to telecommunication systems;
  6. Submitting an annual report to Council including, but not limited to, a summary of the utilization of telecommunication services, a review of any plans submitted during the year by any franchise grantee for the development of new services and a summary report of the Commission deliberations throughout the year in connection with its assigned functions; and
  7. Performing review procedures in accordance with § 715.28 of the Codified Ordinances of the City of Brecksville.
  8. Such additional authority to review all aspects of the telecommunication systems, negotiate franchises as directed by Council, review and monitor telecommunication installations, operations and the performance of any franchise grantee, and make such recommendations to Council as it may from time to time deem appropriate concerning same.

719.03 COMMISSION RULES AND PROCEDURES.

(a) The Commission shall have the authority to submit proposed rules and regulations for the conduct of its business to Council for approval and, upon approval, shall have the right to hold hearings and make recommendations to any franchise grantee and to the educational and governmental communities on the coordination of the educational and governmental access channels. All such actions shall be advisory only.

(b) The Commission shall meet no less than four times every year. All meetings of the Commission shall be open to the public.
